PORTSMOUTH, N.H. -- A worker was taken to the hospital after falling two stories when a portion of scaffolding collapsed in Portsmouth on Tuesday morning. The worker was working on a construction site on Bow Street. Some bricks also fell on top of the worker, police said. A scaffolding company has been fined £25,000 after an employee dropped a scaffolding pole on to a pedestrian below, fracturing her collar bone.
Employees from Jubilee Scaffolding Company Ltd were dismantling scaffolding on the Esplanade in Jersey in December 2009 when the accident happened. At a hearing in the Royal Court, the company admitted they had failed to comply with Health and Safety Law.
They were given two years to pay the fine and ordered to pay additional costs of £2,000.
The accident occurred when the unnamed woman was walking close to where the scaffolding was being dismantled just before 9am that morning. One of the workmen above accidentally dropped one of the poles and it hit the woman causing serious injuries.
According to the report in the Jersey Evening News, the woman has contacted a personal injury claim solicitor who is representing her in her battle for compensation.
Crown Advocate Sally Sharpe said the company had made no arrangements to close the pavement or divide the working area, so it was separate from members of the public whilst the task took place.
Company director Andrew Millington was present in court but represented by Advocate Philip Livingstone. He told the court that the company took its health and safety obligations seriously and that since the accident the firm had engaged a new safety consultant to provide staff training.
