New York Scaffold Law
The Scaffold Law embodied in New York Labor Law 240 provides specific  protections to workers who are exposed to elevation elected risks. The law also protects workers who are injured by falling objects. The law places responsibility for falls on a third party such as a general contractor or owner. It does not apply to owners of one or two family homes.

Under the law, all scaffolds used in construction, demolition, repairing, altering, painting, cleaning, or pointing of a building or structure are required to give proper protection. Scaffolding should have safety rails and strong planking, and should be able to bear significant loads. In addition, scaffolding should be fastened so that it is prevented from swaying. Scaffolding, and other devices used to work at elevated heights, must be maintained in good repair.

When an injury is caused by the absence or defect of a safety device, the Labor Law provides that absolute or strict liability for injury to a worker be placed on the owner or contractor.
